YOUWIN IS A BRAND NAME OF BLUE PEPPER B.V. (HEREINAFTER ALSO REFERRED TO AS "WE", "US", OR "COMPANY"), WITH A REGISTERED OFFICE ADDRESS AT VILLA PARK ROOI CATOOTJE 6, CURAÇAO.

THE COMPANY IS LICENSED UNDER THE LAWS OF KAHNAWAKE TO OFFER ONLINE GAMING SERVICES AND PRODUCTS UNDER THE AUTHORITY GRANTED BY THE KAHNAWAKE GAMING COMMISSION. THE LICENSE NUMBER IS 00925.

  1. Before using our service and product, you must carefully read and fully accept these Terms and Conditions (hereinafter referred to as the Terms). Placing a bet on Youwin indicates the player's acceptance of these Terms. Please note that these Terms constitute a legally binding agreement between the player and Blue Pepper B.V., which operates and manages the website with the internet address specified in Clause 2 of these Terms.
  2. Blue Pepper B.V. owns and operates the Youwin website (hereinafter referred to as the website and/or service), but alternative domain names may be used exceptionally to permit access to the website in certain countries.
  3. All bets placed through this website and its affiliates (hereinafter referred to as bets) are governed, stored, received, and processed according to Curaçao laws.
  4. The agreements defined here are made exclusively between the Company and each user who places bets on this website.

    b. Accepted address verification documents include a residence certificate with a barcode in PDF format downloaded from e-government that is not older than one month or electricity, water, gas bills, bank/credit card statements, or telephone bills (not mobile phone bills - these documents must be dated within the last 6 months).
  8. The Company is not obliged to provide any reason to the user for refusing to open an account, rejecting individual bets, and/or limiting certain bets and/or limits.
  9. The Company reserves the right to close an existing user account without giving any reason. In this case, we will inform the user about their account balance. The user's bet will be excluded immediately, especially in the event of suspected bet fraud or fraud attempts.
  10. The Company is not responsible for any damage or loss arising or alleged to have arisen in connection with the use of the website or service; these include, but are not limited to, delays or interruptions in operations or transmissions, data loss or corruption, communication or line failures, misuse of the website or content by any person, or any errors or omissions in the content. We will also not be liable for any incorrect or obvious errors caused by our suppliers.
  11. You warrant that any username used by you in connection with the website will not infringe the intellectual property, privacy, or other rights of any third party. The user grants Blue Pepper B.V. a general, irrevocable, transferable, royalty-free, sublicensable right to use such usernames for any purpose related to the website or service, subject to our Privacy Policy.
  12. The Company accepts no responsibility for the unauthorized use of usernames and passwords by accounts created by unauthorized persons. The responsibility to keep each user's username and password confidential rests with the user.
  13. As a security measure, the user's password must consist of at least eight characters and include a combination of uppercase letters, lowercase letters, numbers, and symbols (excluding popular symbols). The password should not contain similar characters as the other provided data, such as your name or the name of your city.
  14. The user may only participate in the website in a personal capacity, and it should only be used for entertainment purposes.
  15. Users are advised to review these Terms regularly.
    It is the user's responsibility to always review these Terms while using the website/service.
  16. The Company reserves the right to withdraw its individual rights under these Terms, but users are not automatically entitled to withdraw these rights as long as they continue to use the website.
  17. Users should be aware that all bets placed are valid and subject to the latest version of the betting terms. There is only one version of these Terms. These Terms may be published in several languages to reflect the same principles and provide information to users. However, the legal basis of the relationship between the user and Blue Pepper B.V. is only the English version, and in the event of a discrepancy between the English version of these Terms and versions in other languages, the English version shall prevail.
  18. Blue Pepper B.V. reserves the right to partially or fully limit or refuse access to a user account. If the Company believes that the user has engaged in fraudulent, illegal, dishonest, or inappropriate activities while using the website and service or attempts to engage in any of the activities specified in these Terms, Blue Pepper B.V. reserves the right to take any action it deems appropriate, including but not limited to:
    a. Immediately blocking a user's access to the website;
    b. Seizing the funds in the user's account;
    c. Terminating the user's account; and/or
    d. Initiating legal action against a user.

III. Definition of Winnings

  1. The Company reserves the right to correct miscalculated or confirmed winnings later. In such a case, the bet will be recalculated based on the corrected odds, and the result winnings will be paid to the user at the corrected odds. Incorrectly paid winnings must be returned to us; otherwise, if it remains in your account, your account balance will be adjusted accordingly.

IV. Refunds and Winning Limits

  1. For Sports Betting, Casino, and Live Casino games, there is a weekly winning/refund limit of €200,000 or the equivalent in the player's chosen currency for each user.
  2. For Sports Betting Coupons, there is a winning limit of €100,000 or the equivalent in the player's chosen currency.
  3. For Casino and Live Casino games, the maximum payout per game round is €500,000 or the equivalent in the player's chosen currency. Winnings that exceed this limit in a single game round will be limited to €500,000, and the remaining balance will be voided.
  4. The Company reserves the right to block refunds in cases of suspicious bets and fraudulent sports events until the investigation is complete. Winning payments will be suspended until the investigation of the relevant event is concluded.
  5. Winning payments may be delayed for up to 30 days.
  6. The Company reserves the right to void winnings or bets on bets found to be fraudulent or involving match-fixing (e.g., match-fixing) in sports events. The bet amount will be refunded.
  7. The Company retains the authority to void winnings from Casino and Live Casino games when any error, virus, glitch, malfunction, or inconsistency in the game software is exploited to the player's advantage.

 

V. Opening an Account

  1. To place bets and deposit funds, you must first register on the website and create a user account (hereinafter referred to as the "User Account").
  2. To register on the website and create an account, you must warrant that you are not currently on any regulatory or sanction list that prohibits the Company from doing business or other transactions with you or providing services to you. You must also warrant that you are not prohibited from engaging in financial transactions with the Company due to your geographical location or any other reason. Specifically, you are not located in any of the following countries: Iran, North Korea, Netherlands, France, Germany, Italy, Sweden, the United States and its dependencies, including military bases and regions such as American Samoa, Guam, Northern Mariana Islands, Puerto Rico, and Virgin Islands, Russia, Belarus, Syria, Yemen, Myanmar, Venezuela, Afghanistan, Burkina Faso, Mali, Bahrain, Belgium, Bulgaria, Croatia, Cuba, Curaçao, Czech Republic, Denmark, Estonia, Greece, Hungary, Iraq, Israel, Jordan, Latvia, Lithuania, Marshall Islands, Martinique, New Caledonia, Norfolk Island, Portugal, Romania, Saudi Arabia, Slovakia, Slovenia, Somalia, Spain, Sweden, Isle of Man, United Kingdom, Wallis and Futuna, or any other jurisdiction where your participation would conflict with applicable law. You may not receive services from these countries, and if we determine that you are in such a country, we may immediately terminate your account and your access to the website(s) and service(s).
  3. Individuals opening a User Account on the website must meet the following acceptance criteria (but are not limited to):
    a. Be 18 years of age or older or be of the age specified by the applicable jurisdiction where the user resides; this age must not be less than 18 years.
    b. Do not attempt to deposit or continue to deposit income obtained from illegal activities.
    c. Create a User Account for personal use, not for commercial purposes.
    d. Fully comply with the jurisdictional conditions specified above in Clause 2.
    e. Be the sole owner of the User Account and not share the User Account with any other party.
  4. During the registration process, you must choose a username and password to log in to the website. It is the user's responsibility to ensure the secure storage of their login information. You should not share your login information with anyone or allow another person to use your User Account. Blue Pepper B.V. is not responsible for the misuse of your User Account due to the intentional or accidental, passive, or active disclosure of your login information to any third party.
  5. If you discover that you have more than one registered User Account, you must notify us immediately. Failure to do so may result in your User Account(s) being closed to further access.
  6. After opening an account, the Company reserves the right to forfeit all funds in an account found to be in violation of the rules specified in these terms.
  7. The Company guarantees the strictest confidentiality obligations for all user accounts. However, we are only required to disclose information upon request from a law enforcement agency or our regulatory authority. Please review our Privacy Policy for more information.

  9. During the registration process, you can select a currency. The currency used by each user will be the currency selected when the account is opened and cannot be changed later. Please note that users are not automatically entitled to choose their account currency.
  10. Transfers between accounts are not allowed between players. Similarly, funds cannot be transferred from one User Account to another.
  11. You may only have one User Account registered in your name and using accurate and real personal information. If you attempt to open more than one User Account, all accounts attempted to be opened by the user may be blocked or closed, and all bets and/or wagers may be canceled without notice.
  12. Uncertain Bet: The Company reserves the right to reject and void an uncertain bet.
  13. Corporate Bets: Users must always place bets individually. If one or more users place the same bet multiple times, the bet will be voided. Another example is if multiple users belong to a betting organization/association or syndicate, each placing a bet multiple times in a short period, and the bets are placed together. This rule applies even in such cases. In this case, the Company reserves the right to forfeit your account balance.
  14. If the Company mistakenly deposits funds that do not belong to you into your User Account due to technical or human error or any other reason, the amount will remain the Company's property, and the amount will be transferred from your User Account. If you withdraw funds that do not belong to you before the Company becomes aware of the error, the mistakenly paid amount will become your debt to Blue Pepper B.V., without prejudice to other remedies and actions that may be available under the law. In the event of an incorrect credit, you must notify the Company by contacting customer support or via email.
  15. No bet will be confirmed until it is presented to the account holder in the "Your Bets" section of the account.
  16. The Company reserves the right to grant bonuses to its users if certain criteria and conditions are met. The applicable criteria will apply when you place a bet, and you will be informed online or by email that a bonus has been provided to you. The granted bonus will be automatically credited to your account.
  17. Users have the right to close their accounts at their discretion. This can be done by contacting customer support and/or through the User Account settings. Please note that only the Company can reopen an account closed for reasons other than responsible gambling. Any account closure related to self-exclusion and/or problem gambling behavior will not be reopened.
  18. Regarding payments deposited and withdrawn from your User Account:
    a. You can deposit and withdraw funds from your User Account using different payment methods, such as credit cards and electronic wallets. It is not possible to deposit or withdraw cash.
    b. All payments are made through a secure connection to prevent unauthorized third-party access as much as possible.
    c. The Company reserves the right to set minimum and maximum deposit amounts for each payment method. The Payment Methods page on the website contains all terms and conditions and explains the payment process in detail.
    d. Depending on the payment method, the Company reserves the right to charge a transaction fee. Each fee can be found on the Payment Methods page on the website and the payment process is also clearly stated.
    e. The Company reserves the right to add, remove or adjust the available payment methods at any time.
    f. You will be held responsible for any fees such as bet cancellation, suspension or chargeback due to incorrect deposits.
    g. Users who prefer electronic payment will no longer have the right to cancel the payment once it has been officially made. In addition, internationally accepted regulations and laws will apply to the electronic payment process.
    h. Blue Pepper B.V. is not a financial institution. We do not pay interest or provide credit facilities on the balance in your account, regardless of the amount.
    i. The Company is required by law to verify the identity of each user. Blue Pepper B.V. also reserves the right to conduct in-depth identification at its own discretion.
    j. Payments to and from your User Account (i.e. deposits and withdrawals) must only be made from payment instruments registered in your name. The use of third-party payment instruments not in the name of the User Account holder is strictly prohibited. In the event that payments are determined to originate from third-party payment instruments, these instruments will be deactivated on the site, payments will be immediately returned to the third-party account, and all bets placed and winnings may be forfeited.

VI. Withdrawals

Online Betting Account

  1. All withdrawal requests will be verified and manually processed. Transfer arrangements are not made automatically.
  2. All deposits must be used for gaming/betting purposes. You can request a withdrawal of your winnings resulting from gaming/betting.
  3. Bonus withdrawal conditions vary depending on the bonus, so please carefully read the General Bonus Terms listed in these Terms as well as the individual bonus terms.
  4. The user owns the current winnings balance. If the User Account is used in accordance with these Terms and the law, the user has the right to request the withdrawal of funds from their confirmed User Account. In this case, please use the withdrawal request form on the withdrawal page of the website to request the processing of your withdrawal.
  5. Payment will be made to the account you own in your name, depending on the payment method you select (under Clause 18(j) above). However, the Company reserves the right to delay the withdrawal until valid identification or proof of ownership of the payment method is received. When a withdrawal request is made, we reserve the right to withhold payment until the card is fully verified by the issuing bank.
  6. Payment complaints must be submitted to the Company by the user within 30 days of the request.
  7. Users may request a withdrawal once a week (Monday to Sunday) without any fees. In the case of more frequent withdrawals, the Company will deduct a fee of 5.5% of the requested amount or a minimum of €5 or the equivalent amount in the user's account currency for each subsequent request.
  8. The Company reserves the right to reject payments from or to certain payment instruments.
  9. Please note that you may not request a withdrawal until the total amount deposited has been wagered at least once.
  10. The Company reserves the right to request additional procedures and methods as well as proof from you to verify your identity and other data provided by you at any time. By using the information provided to us by a user after registering a User Account on the website, we reserve the right to conduct identity checks on a user with third-party services. You are informed that we conduct verification procedures on transacting customers, either by ourselves or through third parties. At the time of deposit and/or withdrawal (or both), or at any other stage at the discretion of Blue Pepper B.V., you may be required to provide us with documents such as a copy of your passport or other identification documents. Our Know Your Customer (KYC) procedures, as well as additional documents verifying the user's residential address and/or additional evidence of ownership of the payment instrument. We may also request previously provided KYC documents that will expire or no longer be valid for any reason or additional KYC documents at any time for any reason. If you fail to provide the requested information or documents or if the information or documents provided by you are found to be false or misleading, your User Account may be blocked or closed. We reserve the right to close your User Account and withhold all funds held in the User Account until the verification process is complete.
  11. If, after completing our verification checks, we suspect that the User Account or payment methods used by the user belong to an individual under 18:
    a. All transactions will be voided, and all relevant funds deposited by the user will be refunded, where possible, using the payment method used to deposit these funds, and all winnings will be forfeited.
    b. The User Account will be closed.
  12. Withdrawals must be made using the same method as the deposit whenever possible. The Company reserves the right to require you to withdraw funds using a specific payment method or to require the withdrawal of funds to an alternative payment method to comply with anti-money laundering policies and regulations. If you have deposited with multiple payment methods, the Company reserves the right, at its discretion, to split your withdrawals between different payment methods.

 

VII. About Bets on the Site

  1. Bets are only allowed if the User Account has sufficient balance.
  2. If a bet is placed due to a technical error despite an insufficient balance, the bet will be voided. In this case, the Company will not be responsible for any damages, and your account will be reset to its original position before the bet was placed.
  3. In rare cases, if information that the result may already have been determined is disclosed within the betting period, the Company will set a new deadline for the bet or declare the bet void.
  4. The Company is not responsible for any typographical errors, transmission errors, or assessment errors made by users. Specifically, the Company reserves the right to void a bet even after the results have been announced due to obvious errors (e.g., typographical errors, incorrect matchups, clearly inappropriate odds and handicaps, low/high goals given in bets, etc.), including errors in entering odds and/or evaluating bet results. The Company is also not responsible for the accuracy or completeness of the information it provides or for the currency of this information (e.g., odds list or live scores). Only bets confirmed and recorded by the Company will be valid.
  5. You can only place bets online through our site. Bets cannot be submitted by mail, fax, email, or any other method. All bets received through these methods will be void, whether they win or lose.
  6. A bet is confirmed when it is electronically approved online by the Company (i.e., when the bet is received).
  7. If the date and time of a bet's approval are unknown due to a communication error or if the user does not have the required personal data, the bet will be void. In this case, the bet amount will be refunded.
  8. Bets received after the start of the betting event will also be void. However, this rule does not apply to live betting.
  9. The bet limit is determined by the Company.
  10. Placing bets on behalf of betting companies and brokers or even allowing employees of these companies to place bets is not allowed. For example, if a user participates in a sports event as a participant, organizer, coach, or club official, betting on that event is not allowed. In rare cases where such situations occur, the Company reserves the right to cancel these bets even after the event has concluded, and winnings will be forfeited.
  11. Your winnings will be automatically transferred to your account. However, we may withhold winnings until the official match report is released.
  12. The Company's records shall be definitive for each bet. We may also disclose records upon request. We may also correct your betting account to correct any obvious errors, typographical errors, or miscalculations.
  13. If users want to see the accuracy of bet details, they may be allowed to cancel certain betting slips. However, this is a voluntary action of the Company, and the user does not automatically have the right to cancel the betting slip. This cancellation request can only be made online from the "My Bets" page. Therefore, it cannot be requested via email, mail, fax, phone, or other communication tools. As a general rule, live bets cannot be canceled.

 

VIII. Account Information

    c. Live casino products (online and mobile casinos) are only available in the "play for real (paid) version" and therefore can only be played with real money.
    d. We prohibit third-party assistance tools and software (TPAs) that provide users with an "unfair advantage." We consider "TPA Tools" to include, but are not limited to, items such as computer software, websites, and reference materials. We prohibit the use of the following TPA tools, including but not limited to:
    i. Tools or services that hide the user device used and the operating system installed.

The Company reserves the right to treat any use of the above-mentioned TPA Tools as a material breach of these Terms and, accordingly, has the right to terminate a User Account if a user is found to have engaged in or attempted to engage in such activity, regardless of the outcome of such an attempt. If such termination occurs under this Article, the Company reserves the right to seize funds resulting from such behavior.

 

XII. Data Protection Rules

  1. Users must understand that the Company obtains personal data due to the storage and processing of betting information as part of the betting process.

  6. Permanently Blocking Account Access (Self-Exclusion):
    If you believe you are at risk of developing a gambling problem or believe you already have a gambling problem, you can permanently block access to your account, and your account will be permanently terminated. Once confirmed, we will block your account, and you will never be granted access or be allowed to open another account. All accounts are matched to your identity, so when you open a new account, it will be closed, and the remaining money will be returned to you.

 

XV. Anti-Money Laundering 

  1. As a gaming operator, we must comply with anti-money laundering regulations.
  2. All transactions will be monitored for the prevention of money laundering. The Company will report any suspicious transactions to the relevant authorities in Curaçao. If the Company becomes aware of any suspicious activity related to any of the Games, it must immediately report this to the relevant authorities. The Company may suspend, block, or close a User Account and seize the funds if requested to do so under applicable national and supranational laws, laws, and orders related to Anti-Money Laundering and Combating the Financing of Terrorism.

XVI. Inactive and Dormant Accounts

  1. If an account remains inactive for 12 months, the Company will classify it as inactive. Six months before your account is deemed inactive for 12 consecutive months, the Company will make all necessary attempts to return the remaining funds to you.
  2. After 12 months of uninterrupted inactivity, the Company reserves the right to apply a periodic administration fee. These fees will be applied from the date your account is marked as inactive and will not exceed the balance in your account. A monthly fee of €10 (or the equivalent in your currency) or 10% of the balance in the inactive account (whichever is greater) will be applied for each subsequent calendar month (also known as an inactivity fee). The inactivity fee will be deducted from the inactive account until one of the following occurs: (a) the balance of the inactive account is reduced to zero; or (b) the inactive account is reactivated by you. In either of the cases mentioned in this clause (a) and (b), the deduction of the inactive account fee will be stopped.
  3. We reserve the right to close an inactive account with a zero balance. 

XVII. Limitation of Liability  

  1.  Telecommunications networks and Internet access services necessary for you to access and use the service are entirely beyond our control, and we will accept no responsibility for any interruptions, delays, capacity restrictions, or other shortcomings affecting them.
  2. Before or during the use of the service, you represent, warrant, and acknowledge that the use of the service is entirely at your choice, discretion, and risk. The service is provided without any express or implied warranties.
  3. Without prejudice to the generality of the foregoing clause, we, our directors, employees, partners, service providers:
    a. Do not warrant that the software, games, and website are suitable for their intended purposes;
    b. Do not warrant that the software, games, and website are error-free;
    c. Do not warrant that the software, games, and website will be accessible without interruption;
    d. Will not be liable for any direct, indirect, special, consequential, incidental, or otherwise arising loss, cost, expense, or damage resulting from your use of our service, the website, or your participation in the games.
  4. You understand and agree that all bets/games placed during such a malfunction will be void in the event of a malfunction in a game or the interoperability of the game. Winnings derived from a malfunctioning game and subsequent game rounds using those winnings will be void, regardless of which Games the winnings were played.
  5. In no event shall any member of Blue Pepper B.V. be liable for any special, incidental, direct, indirect, or consequential damages (including but not limited to loss of business profits, business interruption, loss of business information, or other material losses) arising from the user's use (or misuse) of the Service, even if negligence is involved.
  6. You agree to indemnify and hold harmless Blue Pepper B.V., its directors, employees, partners, and service providers from any costs, expenses, losses, damages, claims, and liabilities arising from:
    a. Your breach of these Terms, whether in whole or in part;
    b. Your violation of any law or third-party rights; And
    c. The use of the service by any person accessing the service using your login credentials, whether or not such access is authorized by you. 

 

XVIII. Breaches, Penalties, and Termination

  1. If you breach any provision of these terms, or if we have reasonable grounds to suspect that you have breached them, we reserve the right to refuse to open, suspend, or close your User Account.
  2. If we suspect that you are engaged in illegal and/or fraudulent activities while using the service or the website; or if we believe that you are violating these Terms, we may, at our sole discretion, freeze or terminate your User Account, seize deposits, or cancel any bets 

 

XIX. Miscellaneous 

  1. Nothing in this contract creates or provides any rights or benefits in favor of third parties who are not parties.
  2. Nothing in this contract constitutes or is presumed to constitute a partnership, agency, trust agreement, fiduciary relationship, or joint venture between you and the Company.
  3. The user must provide full and accurate information regarding all details and information requested by us in connection with your use of the service and website, subject to the provisions of the Privacy Policy.  

XX. Entire Agreement

  1. If the enforceability of these terms is illegal, invalid, or unenforceable in any jurisdiction, it shall not affect the validity or enforceability of any other provision herein in that jurisdiction or the validity or enforceability of these terms in any other jurisdiction.
  2. We reserve the right to assign or otherwise legally transfer these terms. You may not assign or otherwise transfer these terms.
  3. These Terms, except in cases of fraud, constitute the entire agreement between you and us concerning the website and games or service and supersede all prior or contemporaneous communications and offers, whether electronic, oral, or written, between you and us.  

 

XXI. Governing Law and Jurisdiction 

These rules are governed by the laws of Curaçao, and the parties agree that any dispute, controversy, or claim arising out of or in connection with these terms, their breach, termination, or invalidity, shall be submitted to the exclusive jurisdiction of Curaçao.
